WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SITE OR MATERIALS ON THIS SITE OR ON THIRD-PARTY SITES IN TERMS OF THEIR CORRECTNESS, ACCURACY, TIMELINESS, RELIABILITY OR OTHERWISE.
You agree at all times to defend, indemnify and hold harmless CORONADO GLOW®, its affiliates, their successors, transferees, assignees and licensees and their respective parent and subsidiary companies, agents, associates, officers, directors, shareholders and employees of each from and against any and all claims, causes of action, damages, liabilities, costs and expenses, including legal fees and expenses, arising out of or related to your breach of any obligation, warranty, representation or covenant set forth herein.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL WE, OUR SUBSIDIARY AND PARENT COMPANIES OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SITE, INCLUDING ITS MATERIALS, PRODUCTS, OR SERVICES, OR THIRD-PARTY MATERIALS, PRODUCTS, OR SERVICES MADE AVAILABLE THROUGH THE SITE, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY AND THE LIABILITY OF OUR SUBSIDIARY AND PARENT COMPANIES OR AFFILIATES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.) YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT WE ARE NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER. IF YOU ARE DISSATISFIED WITH THE SITE, ANY MATERIALS, PRODUCTS, OR SERVICES ON THE SITE, OR WITH ANY OF THE SITE’S TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE AND THE PRODUCTS, SERVICES AND/OR MATERIALS.
THIS SITE IS CONTINUALLY UNDER DEVELOPMENT AND COMPANY MAKES NO WARRANTY OF ANY KIND, IMPLIED OR EXPRESS, AS TO ITS ACCURACY, COMPLETENESS OR APPROPRIATENESS FOR ANY PURPOSE.
PARTICIPANT ACKNOWLEDGES AND AGREES THAT NO REPRESENTATION HAS BEEN MADE BY COMPANY OR ITS AFFILIATES AND RELIED UPON AS TO THE FUTURE INCOME, EXPENSES, SALES VOLUME OR POTENTIAL PROFITABILITY THAT MAY BE DERIVED FROM THE PARTICIPATION IN THIS PROGRAM.
WAIVER AND LIABILITY RELEASE
By Booking an Appointment with Coronado Glow®, You Automatically Consent and Agree to the Following:
• Caution – The effect of the spray tan ingredient DHA (Dihydroxyacetone) on pregnant or nursing mothers and their babies is unknown. Pregnant or nursing women should therefore consult their physician before their session.
• Warning – The spray tan ingredient DHA (Dihydroxyacetone) has been approved only for external application and should not be inhaled or ingested internally.
• Warning – This product does not contain a sunscreen and does not protect against sunburn.
• Repeated exposure to the sun of unprotected skin while sun tanning may increase the risk of skin aging, skin cancer and other harmful effects to the skin even if you do not burn.
• Spray tanning is accomplished in part by application of a solution containing the active ingredient DHA. According to the FDA (Food and Drug Administration), DHA is a color additive for use in imparting color to the human body. However, its use in cosmetics -- including sunless "tanning" products -- is restricted to external application.
• The solution used at Coronado Glow® is hypoallergenic, and is all-natural; therefore an allergic reaction is highly unlikely. However, you do assume that there is a very small risk for a reaction to the solution and waive Coronado Glow® of any liability relating to such a reaction.
The FDA advises that spray tan users should avoid inhaling or ingesting DHA or letting the spray get into your eyes. When using DHA-containing products as an all-over spray or mist, it may be difficult to avoid exposure in a manner for which DHA is not approved, including the area of the eyes, lips, or mucous membrane, or internally. Therefore, it is recommended that you take protective measures to eliminate eye contact, inhalation or ingestion during your spray tan session, such as:
• Using protective eyewear
• Wearing nose filters*
• Sealing lips with lip balm*
• Using protective undergarments*
*Coronado Glow® has these items available upon request.
Male clients are required to wear undergarments. Female clients may wear whatever they feel comfortable with. You may bring/use your own protective items.
The spraying process will take approximately twenty (20) minutes. After spraying, you will dry approximately five (5) minutes before putting your clothes back on, and you should not shower, bathe or sweat excessively for at least eight (8) hours or for rapid sessions at least two to four (2-4) hours.
The bronzing and tanning solutions used during your session have the potential to stain clothing. We recommend that you wear something dark in color that can be stained without concern. Cotton clothing is less likely to stain. After your tanning session, you should wear dark, loose fitting clothes.
It is also possible that the tanning solution may transfer to other clothing, furniture or car seats after your session. Washing or dry-cleaning will usually, but not always, remove the color. We suggest bringing a towel to cover your car seat. Coronado Glow® is not responsible for potential stains to clothing or upholstery. Please be careful.
PARENT / GUARDIAN CONSENT (if client is under the age of 18)
If the spray tan client is under the age of 18, a parent or legal guardian must also read and understand the above information and provide their consent and approval for the tanning session. Coronado Glow® reserves the right to refuse service if the parent/guardian is not present to provide consent prior to tanning session.
Cancellation Policy
Coronado Glow® has a Booking Policy designed to protect not only our business' bottom line and in turn, our affordability, but also to keep things fair for all clients.
No shows and last minute cancellations enormously disadvantage our business. They also mean that other clients cannot book those time slots with us. We employ the very best spray tan technicians and we invest a great deal in further educating them, therefore we hope that you will appreciate our Booking and Cancellation Policy.
50% deposit required for all group tanning sessions and is non-refundable if spaces are not cancelled within 24 hours prior to the scheduled appointment.
100% fee will be charged for late cancellations and no-shows. A late cancellation is classed as 23 hours or less prior to your scheduled appointment time. A no-show is classed as not showing up at all. In the event of a no-show, a new appointment must be scheduled which will result in a full service fee due for such service; same day appointments may not be available.
Late arrival is classed as being late by 10 minutes or more for your appointment. Late arrivals must wait until the next appointment slot is available on the day of your appointment if there are appointments immediately following your originally scheduled time. A $15 late fee will be added to the cost of service should you choose to wait for the next available time slot on the same day. If you choose to forgo waiting the same day and reschedule for another day, a 100% fee will be added to the cost of service.
Same day appointments are not allowed to be rescheduled as they are booked within hours of being requested and requires shifting of schedules to make sure you are seen same day. 100% fee for same day appointments will be charged if such appointment is canceled, rescheduled, or if you no-show.
Please note that if we are able to re-book somebody into your time slot a cancellation fee will not apply.
We do understand that sometimes you may need to change your booking. We kindly request 24 hours notice so that we can offer that time slot to another client and allow time for them to properly prepare for their appointment. However, if you don’t provide us with 24 hours notice, or you fail to arrive for your appointment, you will be automatically charged the appropriate amount according to our cancellation fee structure.
The only exception for late cancellations is for bad weather. As Coronado Glow® prides itself on its high standard of spray tanning, and as water can potentially damage your spray tan before it has a chance to fully settle and develop, we would rather you postpone/cancel your appointment than risk damaging your tan on your travels to and from your appointment. If you do wish to make a last minute cancellation for your appointment due to bad weather (ie heavy rainfall & storms), there will be no cancellation fee applied. No shows will still incur the full 100% payment regardless. Please note to qualify for a wet weather late cancellation you can only cancel within 1 hour of your scheduled appointment time, and it must be bad enough weather to deem it impossible to walk out of your appointment and into your car without damaging your spray tan. A slight drizzle does not count as bad weather. We have given a 1 hour time frame as we are all aware of how quickly the weather can change, so we do not accept wet weather cancellations in the morning for an evening appointment.
There are absolutely no exceptions to this new policy. No matter how good a client is, no matter how long they’ve been with us, and no matter how small the appointment booking is.
What we will allow: Clients are more than welcome to offer their appointment to a friend, associate or family member if they cannot make their appointment to avoid any fees.
